The "Musical Friends" Referral Program ("Referral Program") offered by Innovative Interactive Infotainment Private Limited (MeraGana.com) has been created to reward you, our loyal Customers ("Referrer" / "Participant") for doing what you would already do – recommending us to friends and family who sign on to become MeraGana.com subscribers ("Referred Friend"). The following MeraGana.com Referral Program Terms and Conditions ("Program Terms and Conditions") contain important information about our Referral Program. These Program Terms and Conditions are a binding agreement between you and MeraGana.com and will govern your participation in any and all Referral Program offers. By participating in the Referral Program, you agree to the Program Terms and Conditions and the Privacy Policy. You are not authorized to participate in the Program, if you do not agree to these Program Terms and Conditions in their entirety.

The "Musical Friends" Referral Program is valid for all Referrals provided and Subscriptions by Referred Friends only after 01 April 2015.
1. QUALIFIED REFERRALS:
A Qualified Referral occurs when:

a) The Referrer, an active subscriber of MeraGana.com, clicks the "Refer a Friend" Program link, after signing in on the MeraGana.com site and enters Names and Email IDs of their Referred Friends;

b) The Referred friend should not be an existing subscriber or previous subscriber of MeraGana.com

c) Self referral will not be considered valid under the Referral Program and rewards points will not be applicable for self-referrals or fraudulent transactions

d) The Referred Friend then Subscribes and makes a successful payment at the MeraGana.com website by clicking the Referral Program link shared by MeraGana.com or by coming directly to the MeraGana.com website;

e) Referrer will be eligible for Reward Points on the first successful subscription transaction by the referred Friend. The Referrer will not be eligible for Reward Points on Renewals and / or Extension of Subscription and / or purchase of any product or Service beyond the first successful subscription transaction by the Referred Friend.

f) The Referred friend mentions the same email id as was provided by the Referrer at the time of providing the referrals and mentions the Referrers Email ID at the time of Applying for a MeraGana.com subscription. The Referrers Email ID cannot be changed at any later stage

g) In case the Referred friend has been referred by more than one Referrer, the Referred friend will be allowed to use their discretion to nominate any one Referrer for the Referral Reward Program. Only one referrer will qualify for the Reward Points.

h) The Referred Friend subscribes for a qualified product or service applicable at the time of Subscription

i) The Reward Points differ for different products and services and some of the products and services may not be eligible for Reward Points. The Reward Points change from time to time. You are requested to check the applicable product list for the Reward Point Structure.

j) The Referred Friend has been accepted by MeraGana.com as a valid subscriber; and only then will the Reward Points (if applicable) be credited in the Referrers Reward Point Account

2. REWARD POINTS REDEMPTION
a) Reward Points can be redeemed only after 7 days from the date of credit of the reward points in the participants account

b) Reward points earned can only be redeemed on MeraGana.com and cannot be converted into cash

c) Program Points cannot be transferred, shared, sold by the participant

d) Reward points can be redeemed only against the applicable products and services. The Redemption of Reward Points differ for different products and services and some of the products and services may not be eligible for Redemption against Reward Points. The number of Reward Points for Redemption for various products and services change from time to time. You are requested to check the applicable product list for the Redemption of Reward Point Structure.

3. EXPIRY OF REWARD POINTS
a) All reward points must be used within 365 days from the date of earning of the points or the date of credit, else they shall expire.

b) Expired Reward points will not be usable by the Subscriber

4. RIGHTS TO MODIFY / SUSPEND / TERMINATE THE REFERRAL REWARD PROGRAM AND / OR ITS TERMS AND CONDITIONS
MeraGana.com reserves the right to modify these Program Terms and Conditions at any time, at its sole discretion, and without prior notice to you. Participation in the Program is considered acceptance of these Program Terms and Conditions and any modifications which might be made. MeraGana.com may also, in its sole discretion, change, cancel, suspend, or modify any aspect of the Program without notice. MeraGana.com also reserves the right to disqualify any customers or prospective customers at any time from participation in the Referral Program.

5. LIMITATION
The Referral Program is only applicable on the domain MeraGana.com and for the online Karaoke service only and is not applicable to subscribers of KS.MeraGana.com or to subscribers of Desktop.MeraGana.com.

6. LIMITATION OF LIABILITY
By participating in the Referral Program, Participants release MeraGana.com, its parent company, subsidiaries, affiliates, suppliers, advertising, and promotions agencies and their respective directors, officers, employees, and agents from any and all liability for any loss, harm, damages, cost, or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Reward Program and / or the use of any Program rewards.

7. INDEMNIFICATION
Participants agree to indemnify, defend, and hold MeraGana.com and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs, or expenses, including attorney’s fees and costs, arising from, or related to any breach by the participant of any of these Program Terms and Conditions or any violation by Participant of applicable law.

8. FORCE MAJEURE
MeraGana.com shall not be liable to any Participant for failure to supply any credit or any part thereof, by reason of a natural disaster, an act of God, war, terrorism, vandalism, government regulations, disaster, fire, strikes, civil disorder, curtailment of transportation facilities, criminal act, or other similar cause beyond its control.

9. GOVERNING LAW AND JURISDICTION
This Terms and Conditions shall be interpreted and governed in all respects by the laws of India. The Courts at New Delhi, India alone shall have sole and exclusive jurisdiction to entertain and decide any disputes or differences, which may arise. Participants hereby waive any right to claim the jurisdiction of any other Court on the ground that the choice of New Delhi, India Courts is onerous or otherwise inconvenient to them.
